# Terms of Service

These Terms of Service apply when you visit or place an order through **cskin.org** (the **Website**). Please read them before using the Website or purchasing from us.
## 1. About CSKIN
The Website is operated by **Caitlin Gallacher trading as CSKIN** (**CSKIN**, **we**, **us** or **our**).

## 2. These terms and your statutory rights
By using the Website or placing an order, you agree to these Terms of Service. Our Privacy Policy, Shipping Policy and Returns and Refunds Policy also apply to your use of the Website and any order you place.
Nothing in these terms affects your statutory rights as a consumer. If there is any conflict between these terms and rights that cannot legally be excluded, your statutory rights will apply.
## 3. Online shop only
These terms apply to products purchased through our online shop. Clinic appointments, consultations and treatments are subject to separate booking, cancellation, consultation and consent terms provided during the booking process or by the clinic.
Information on the Website is provided for general skincare information only. It is not a medical diagnosis or a substitute for advice from a doctor, pharmacist or other suitably qualified healthcare professional.
## 4. Using the Website
You must use the Website lawfully and must not:
- misuse, damage, disrupt or attempt to gain unauthorised access to the Website or its systems;
- introduce viruses, malicious code or other harmful material;
- use automated tools to scrape, copy or interfere with the Website without our written permission;
- use the Website for fraudulent or unlawful purposes; or
- infringe our rights or the rights of another person.
You are responsible for ensuring that information you provide to us is accurate and complete. If you create an account, you are responsible for keeping your login details secure and for notifying us promptly if you suspect unauthorised use.
## 5. Products and product information
We take reasonable care to describe and display products accurately. However, colours and appearance may vary slightly depending on your screen, photography and product batches. Packaging may also change from time to time.
Product ingredients and instructions may be updated by the manufacturer. You should always read the current label, ingredients list, warnings and directions supplied with the product before use. If information on the Website differs from the product packaging, contact us before using the product.
All products are subject to availability. We may apply reasonable quantity limits, including where we believe an order is intended for unauthorised resale.
## 6. Skincare suitability and safe use
Skin responses and results vary between individuals, so we cannot promise a particular outcome from using a product.
Before purchase and use, you should:
- review the ingredients and any warnings, particularly if you have allergies, sensitivities, a medical condition, are pregnant or breastfeeding, or use prescription skincare or medication;
- follow the manufacturer's directions and carry out a patch test where advised; and
- seek advice from a doctor, pharmacist or suitably qualified professional if you are unsure whether a product is suitable for you.
Stop using a product if irritation or an unexpected reaction occurs and seek appropriate medical advice where necessary. Nothing in this section limits any legal rights or remedies you may have if a product is faulty, unsafe or not as described, or where loss is caused by our negligence.
## 7. Placing an order and forming a contract
When you place an order, you are making an offer to buy the selected products. An automatic order acknowledgement confirms that we have received your order, but does not mean that we have accepted it.
A contract between you and CSKIN is formed when we send you confirmation that the order has been dispatched, unless we expressly confirm acceptance earlier.
We may refuse or cancel an order before dispatch where, for example:
- a product is unavailable;
- there is an obvious error in the price or product information;
- we cannot authorise or verify payment;
- we reasonably suspect fraud, misuse or unauthorised resale; or
- we cannot deliver to the address provided.
If we cancel an order after taking payment, we will refund the amount paid for the cancelled item or order to the original payment method.
## 8. Prices and payment
Prices are shown in pounds sterling (GBP) and include applicable UK taxes unless stated otherwise. Delivery charges, where applicable, are shown before you complete checkout.
You must provide a valid payment method that you are authorised to use. Payment may be taken when you place the order. If we discover an obvious pricing error before dispatch, we will contact you and give you the option to purchase at the correct price or cancel for a full refund.
## 9. Discount codes and promotions
Discount codes and promotional offers may be subject to additional conditions stated with the offer. Unless stated otherwise, they:
- must be used before their expiry date;
- cannot be exchanged for cash;
- cannot be applied retrospectively to an order already placed;
- cannot be combined with another code or offer; and
- may be limited to one use per customer or household.
We may withdraw or correct a promotion before an order is accepted if it has been published in error, is being misused or stock is no longer available. This will not affect an order we have already accepted, except where permitted by law.
## 10. Delivery
Our Shipping Policy explains our delivery areas, charges and estimated delivery times.
Delivery dates are estimates unless we expressly agree a specific date. We will deliver without undue delay and within the period required by law. If an event outside our reasonable control delays your order, we will contact you as soon as reasonably possible.
You are responsible for providing a complete and accurate delivery address. The product becomes your responsibility when it is delivered to you or to a person you have identified to receive it, unless the law provides otherwise.
## 11. Cancellations, returns, faults and refunds
Your rights to cancel an online order, return products and request a refund are explained in our Returns and Refunds Policy.
That policy includes conditions for change-of-mind returns and separate rights for products that are faulty, damaged, unsafe, not as described or incorrectly supplied. Any hygiene-related return restriction does not remove your statutory rights where a product is faulty or otherwise does not conform to the contract.
To contact us about a cancellation, return or problem with a product, email **info@cskin.org** with your order number. You may use the model cancellation form at the end of these terms, but you do not have to use it.
## 12. Privacy and marketing
We process personal information in accordance with our Privacy Policy. If you choose to receive marketing, you can unsubscribe at any time by using the link in an email or by contacting us. Transactional messages about your orders are not marketing and may still be sent where necessary.
## 13. Intellectual property
The Website and its content, including text, branding, logos, graphics, photographs, videos and layout, are owned by or licensed to CSKIN and are protected by intellectual property laws.
You may view and make a copy of Website content for your personal, non-commercial use. You must not reproduce, modify, distribute, sell or commercially exploit it without prior written permission from the relevant rights owner.
## 14. Reviews and other content you submit
If you submit a review, image or other content to us, it must be honest, based on your genuine experience, lawful and must not infringe another person's rights or privacy.
You retain ownership of your content, but give us a non-exclusive, royalty-free permission to use, reproduce and display it in connection with CSKIN and our products, subject to applicable law and our Privacy Policy. We may remove content that is unlawful, misleading, offensive, irrelevant or infringes another person's rights.
Do not upload an identifiable image of another person unless you have their permission.
## 15. Third-party links and services
The Website may contain links to third-party websites or services. We are not responsible for their content, availability or privacy practices. A link does not necessarily mean that we endorse the third party. You should review the third party's own terms and privacy information before using its service.
## 16. Our responsibility to you
We are responsible for losses that are a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. We are not responsible for losses that were not foreseeable when the contract was formed.
We supply products for private and domestic use. If you use a product for a commercial, business or resale purpose, we will not be responsible for loss of profit, business, revenue, opportunity or business interruption, to the extent permitted by law.
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- defective products where liability cannot lawfully be excluded; or
- breach of your statutory consumer rights.
## 17. Events outside our reasonable control
We will not be responsible for a delay or failure caused by an event outside our reasonable control. We will take reasonable steps to reduce the effect of the delay and will contact you where it affects an order. Your legal rights, including any right to cancel because of a significant delay, remain unaffected.
## 18. Website availability and changes
We may update, suspend or withdraw parts of the Website for maintenance, security, legal or operational reasons. We do not guarantee that the Website will always be available or error-free.
We may update these terms to reflect changes to our business, the Website, applicable law or regulatory requirements. The terms in force when your order is accepted will normally apply to that order. The latest version will be published on the Website with its updated date.
## 19. General terms
If any part of these terms is found to be invalid or unenforceable, the remaining parts will continue to apply.
If we do not immediately enforce a right under these terms, this does not mean that we have waived that right.
You may not transfer your rights or obligations under these terms without our written consent. We may transfer our rights and obligations where this does not reduce your rights or protections under the contract.
No person other than you and CSKIN has a right to enforce these terms, except where the law provides otherwise.
## 20. Governing law and disputes
These terms and any contract between you and CSKIN are governed by the laws of England and Wales.
If you live in England or Wales, you may bring legal proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts where you live. If you live elsewhere, any mandatory rights available to you under local consumer law remain unaffected.
